Estate Planning & Probate

Estate planning means drafting a plan in advance and naming whom you want to make decisions for you in the event of incapacity as well as stating who will receive the things you own after you pass away. We start by discussing the estate administration process and drafting the necessary documents for your appointment as personal representative (known as an executor in other states). The Dale Law Firm also specializes in military divorce. Military divorce creates its own set of unique issues. As opposed to civilian divorce, military divorce rules include a mix of both state and federal laws which can make the divorce process confusing and complex. Normally with a typical divorce, the state requires at least one party to be a resident of the state. In cases of military divorce that might be difficult since those serving in the military may not always be a legal resident of the state they are currently living in. Due to the special circumstances that a military divorce poses, the state first must establish personal jurisdiction over the parties. Factors establishing personal jurisdiction include where the member is stationed, where you or your spouse reside, and the state where you or the member claim residency. Once the state establishes personal jurisdiction, it must then establish the authority of a court to hear cases of a particular matter. The Dale Law Firm, P.C. will help you navigate these complex issues.
